Assumption of Risk
Participation in dance instruction, rehearsals, performances, competitions, conventions, workshops, conditioning, travel, and other activities associated with Evoke Dance Movement ("Evoke") involves inherent risks. These risks include, but are not limited to, falls, collisions, overexertion, sprains, strains, fractures, concussions, illness, permanent disability, paralysis, death, and damage to personal property. I understand that no activity is entirely free from risk, even when reasonable care is exercised.
I knowingly and voluntarily assume all risks, both known and unknown, associated with my child's participation in Evoke activities. I understand that participation is voluntary and accept full responsibility for any injury, illness, loss, or damage that may occur as a result of participation.
Studio Rules & Safety Compliance
I agree that my child will follow all Studio policies, safety rules, and instructions provided by Evoke's Owners, Directors, faculty, staff, and designated representatives. I further agree to immediately notify Studio staff of any injury, illness, unsafe condition, or medical concern that could affect my child's participation.
Release of Liability
To the fullest extent permitted by California law, I, on behalf of myself, my child, my heirs, executors, administrators, assigns, and personal representatives, hereby release, waive, discharge, and hold harmless Evoke Dance Movement, its Owners, Directors, employees, faculty, independent contractors, volunteers, agents, landlords, facility partners, sponsors, and event hosts (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to participation in any Evoke activity, including those resulting from the ordinary negligence of the Released Parties.
This release does not apply to claims arising from gross negligence, reckless conduct, or willful misconduct where such claims cannot legally be waived under applicable law.
Emergency Medical Authorization
In the event of an illness, injury, or medical emergency, I authorize Evoke Dance Movement to seek emergency medical evaluation, treatment, transportation, and care for my child if I or my designated emergency contact cannot be reached in a timely manner. I understand that every reasonable effort will be made to contact me first and that I am solely responsible for all medical expenses incurred on behalf of my child.
Medical Fitness
I certify that my child is physically capable of participating in dance activities and agree to notify Evoke Dance Movement of any medical condition, injury, allergy, medication, or physical limitation that may affect safe participation. I understand that Evoke Dance Movement reserves the right to require written medical clearance from a licensed healthcare provider before permitting a dancer to return following an injury or medical condition.
Personal Property
I acknowledge that Evoke Dance Movement is not responsible for the loss, theft, or damage of personal belongings brought to the Studio or to Studio-related activities.
Damage to Studio Property
The Parent/Guardian agrees to reimburse Evoke Dance Movement for the repair or replacement cost of any Studio property that is lost, stolen, damaged beyond normal wear and tear, or not returned when requested, including but not limited to props, rehearsal materials, equipment, costumes, furniture, flooring, mirrors, sound systems, or other Studio-owned items.
Parents/Guardians further agree to be financially responsible for any damage to Studio facilities, equipment, furniture, flooring, mirrors, sound systems, or other property resulting from the negligent, reckless, or intentional acts of the Dancer, Parent/Guardian, family members, or guests.
Replacement or repair costs shall be determined by Evoke Dance Movement and are due upon receipt of notice.
Parent/Guardian Acknowledgment & Agreement
I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDICAL AUTHORIZATION. I UNDERSTAND ITS TERMS, ACKNOWLEDGE THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST THE RELEASED PARTIES, AND SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
As the Parent or Legal Guardian of the minor participant, I certify that I have the legal authority to execute this Agreement on the participant's behalf. I have read and understand this Agreement, consent to my child's participation in Evoke Dance Movement activities, and agree to be bound by its terms. To the fullest extent permitted by California law, I agree to indemnify and hold harmless the Released Parties from any claims arising out of my child's participation in Evoke Dance Movement activities, except where prohibited by law.
